Like many other states nationwide, New York now outlines state-wide requirements and regulations pertaining to private swimming pools and their safety features – namely pool fences. Listed in the Uniform Fire Prevention and Building Code, these guidelines apply to any private pool across the state. However, local governments may enact additional regulations in addition to those outlined by the state – you should consult the local laws, ordinances, codes and regulations of the municipality where the pool is to be installed for any further requirements.
First off, the state defines “swimming pool” as any structure, basin, chamber or tank which is intended for swimming, diving, recreational bathing or wading and which contains, is designed to contain, or is capable of containing water more than 24 inches deep at any point. This includes in-ground, above-ground and on-ground pools; indoor pools; hot tubs; spas; and fixed-in-place wading pools. Any guidelines listed apply to all pools mentioned.
Some of the most important guidelines set forth regarding pool safety fences are as follows:
First, the fence must completely surround the swimming pool and must obstruct access to the swimming pool. The barrier must be at least 4 feet (48 inches) high – this is relatively standard among states that have implemented such rules.
In the case of an above-ground pool, the fence may be at ground level or mounted on top of the pool structure; however, if the fence is mounted on top of the pool walls, the gap between the pool wall and the fence cannot exceed 4 inches (so children cannot climb through). If a building wall such as your house forms part of the barrier (or fence), the pool area must be equipped with a safety cover or all doors with direct access to the pool on that wall must be equipped with an alarm.
While some of these regulations seem obvious and self explanatory, there are still a great number of those who fail to provide the required safety features around their pools.
